Terms and Conditions (User Agreement)
1. Parties and Acceptance
These Terms and Conditions (the “Agreement”) are entered into between — (“F5PLUS Information Technologies” or the “Platform”) and the user who registers with the Platform (the “User”, “Member”, “Buyer” or “Seller”). By using the Platform, you are deemed to have accepted these terms.
2. Role of the Platform: Intermediary Service Provider
F5PLUS Information Technologies is an “Intermediary Service Provider” within the meaning of Law No. 6563. It is not the seller, manufacturer or supplier of the items listed on the Platform. The sales contract is concluded directly between the Buyer and the Seller. F5PLUS Information Technologies gives no warranty as to whether items are defective, genuine or lawful; however, it reserves the right to carry out checks under the Platform rules.
3. Membership Requirements
- To become a Member you must be at least 18 years old and have full legal capacity.
- The Member undertakes that the information provided at registration (identity, contact details, address, etc.) is accurate and up to date.
- A membership can be created with an email address or through the social sign-in options offered by the Platform (Google, Apple, Facebook). Whichever method is used, no account is opened until the mandatory agreements have been accepted.
- The Member is responsible for the security of their account. F5PLUS Information Technologies cannot be held liable for any loss arising from a password being shared with third parties.
4. Listing and Selling Rules
- Accurate description: the Seller must describe the item’s features, condition (new/used) and any defects or damage honestly, completely and truthfully.
- Photos: photos used in a listing must show the actual item and be current. Representative or stock images taken from the internet may not be used.
- Pre-loved items: as most items sold are second-hand, the Seller must take the utmost care regarding hygiene and safety.
5. Prohibited Items
The sale of items in the following categories is strictly prohibited on the Platform. Breaching this prohibition will result in the listing being removed and the membership being terminated:
- A) Health / medicines / medical products: all prescription or over-the-counter medicines, antibiotics, hormone medicines, needles, syringes, IV fluids, medical test kits, contact lenses, hearing aids, breast milk and lactation supplements.
- B) Food and perishable goods: opened formula, unlabelled food, products that are past their expiry date or whose date cannot be read, and food requiring a cold chain.
- C) Hygiene and cosmetics: opened or used cosmetics or those with a broken seal (nappy rash cream, shampoo, lotion, etc.), used dummies, used bottle teats, sanitary pads.
- D) Unsafe safety equipment: second-hand car seats (because their accident history is unknown and materials may be fatigued); motorcycle or bicycle helmets; any safety equipment that is damaged, cracked or missing parts, or whose compliance with safety standards (CE, etc.) is doubtful.
- E) Hazardous substances: explosive, flammable or combustible substances, fireworks, toxic chemicals, pesticides, strong cleaning acids.
- F) Weapons and blades: firearms, ammunition, pepper spray, stun devices, daggers, flick knives and other tools that could be used for assault.
- G) Tobacco, alcohol and drugs: cigarettes, cigars, tobacco products, e-cigarettes and e-liquids, alcoholic beverages, narcotics and paraphernalia.
- H) Counterfeit and imitation goods: fake, replica or knock-off items that infringe intellectual property rights, items bearing imitation brands, pirated books and publications.
- I) Stolen and suspicious goods: items known to be stolen or whose ownership cannot be proven, electronic devices with scratched-off or erased serial numbers.
- J) Live animals: the sale of any pet or wild animal.
- K) Materials containing personal data: documents or devices containing another person’s ID, passport, medical report, credit card details, etc.
- L) Adult content: sexual products and pornographic material.
- M) Other unlawful items: any other product or service whose sale, possession or transport is prohibited under applicable law.
Even if not expressly listed above, any other item that does not fit the Platform’s second-hand marketplace concept, is considered inappropriate for the Platform culture or is ethically objectionable is also prohibited and may be rejected at the editors’ discretion. F5PLUS Information Technologies reserves the right to change this list of prohibited items and its scope at any time without prior notice.
6. Orders, Payment and Delivery
- Payments are made through a secure payment infrastructure provided by licensed payment institutions with which the Platform has agreements.
- In return for its intermediary services, F5PLUS Information Technologies charges the Seller a tiered commission based on the sale amount and charges the Buyer a tiered Buyer Protection Fee based on the order amount. The current rates and the amounts applied to an order are shown in the order summary before the order is confirmed.
- In shipping and delivery, costs arising from differences between the package dimensions (volumetric weight) declared by the Seller and the carrier’s measurements may be charged to the Seller.
7. Returns and Right of Withdrawal
- The Buyer may exercise the right of withdrawal under Law No. 6502 against the Seller only for purchases from Sellers acting as traders (sole traders or companies) and where the conditions are met. No right of withdrawal arises for purchases from individual (non-trader) Sellers; the Platform’s return and dispute process applies to such purchases. The Seller type is shown in the pre-contractual information before the order is confirmed.
- After receiving the item, the Buyer must approve the order or report a problem on the Platform within the specified period. Given the nature of second-hand items, “normal wear and tear” may not be accepted as a reason for return.
8. Intellectual Property and Content
The User accepts that the content they upload to the Platform (photos, text, etc.) is lawful and does not infringe the rights of third parties. The User grants the Platform a licence to use this content to provide and promote the service.
9. Breaches and Sanctions
Where a Member acts in breach of this Agreement, the Community Rules or the law, lists prohibited items, or attempts to transact outside the Platform (or redirects others to do so), F5PLUS Information Technologies may:
- remove their listings,
- suspend their account temporarily or permanently,
- notify the competent authorities where necessary.
10. Limitation of Liability
To the extent permitted by law, F5PLUS Information Technologies cannot be held liable for indirect damages, loss of profit or loss of data relating to the use of the Platform or to the quality, safety or lawfulness of items. Mandatory liability arising from consumer protection law is reserved.
11. Dispute Resolution
This Agreement is governed by Turkish law. Consumer Arbitration Committees and Consumer Courts have jurisdiction over consumer disputes; for commercial disputes, the Courts and Enforcement Offices of — have jurisdiction.
